Terms of service

These terms apply to merchants who install Mint Age Check ("the app"), made by Mint Labs ("we", "us"). By installing or using the app you agree to these terms and to our privacy policy.

The service

The app adds a self-declared age check to your online store through a theme app embed: shoppers confirm they're at least the minimum age you set, or type their date of birth. On the Pro plan it can also add a checkout rule to your Shopify store, powered by the app's Shopify Function, that asks for the storefront answer before checkout when the cart has age-restricted items. We may improve or change features; we will not remove a paid feature you rely on without notice.

Not ID verification — your responsibility

The app records what shoppers declare. It does not verify anyone's identity, age or ID documents, and a shopper can answer untruthfully. Using the app does not by itself make your store compliant with any law or regulation. You decide the minimum ages, where the check applies and the texts shoppers see, and you are responsible for knowing and meeting the age-related legal requirements that apply to your products, your store and the places you sell to (which may require stronger checks, such as ID verification at checkout or on delivery). Nothing we provide is legal advice.

The storefront check runs in the shopper's browser and needs JavaScript; a shopper who blocks scripts will not see it. If the checkout rule itself ever fails to run, Shopify lets the checkout continue rather than blocking your customers.

Billing

Plans are billed by Shopify every 30 days in USD after the free trial. You can cancel at any time by changing plans or uninstalling the app. Charges are handled entirely by Shopify under Shopify's terms.

Availability and liability

We work to keep the app available, accurate and secure, but it is provided "as is". To the extent the law allows, our total liability is limited to the fees you paid for the app in the 3 months before a claim.

Data processing addendum

The app is designed not to collect or store personal data of your customers: a date of birth is used only in the shopper's browser and never sent to us, the answer is kept in a cookie on the shopper's own device, and the checkout rule runs inside Shopify without network access. To the extent the app processes any personal data on your behalf, you are the controller and we are the processor, and we will:

  • process personal data only to provide the app's features, following your instructions given through the app's settings;
  • process only the minimum data needed, and never store customers' birth dates, ages, names, email addresses, phone numbers, addresses, orders or carts;
  • never sell personal data, use it for advertising, or use it to train AI models;
  • keep data confidential and limit access to authorised personnel;
  • encrypt data in transit (HTTPS) and at rest (Cloudflare D1 encryption at rest);
  • use Cloudflare (hosting and database) and Shopify as our only sub-processors;
  • delete all shop data after uninstall (shop redaction) and respond to Shopify's customer privacy requests;
  • help you respond to data subject requests and notify you without undue delay of any personal data breach.

Changes

We will post changes to these terms here and update the date above. Significant changes will be announced in the app.
